Changes and Cancellations
If you would like to cancel or change your order, please email: info@pcraingutter, or call 435-649-2805 as soon as possible. We will do everything we can to accommodate your request. Please remember that we try to get all orders out as quickly as possible. Once the order is packed, we cannot change or cancel it.
All cancellations mush have written confirmation from Park City Rain Gutter by fax or email. If you cancel your order after it has been packed and or refuse the shipment, you will be responsible for all freight and crating charges plus a 20% restocking fee. In addition, sale of all special order items is final.
We want you to be a happy customer! If you are not satisfied with your purchase, you may return it within 30 days of receipt and we will refund the purchase price less a 20% restocking fee and shipping costs. You must call us at 435-649-2805 to get a RA# (return authorization) prior to return shipment. The return shipment must have a copy of the RA# attached. Refunds will not be made on returned merchandise without a RA#. A credit card refund or check will be issued within 14 days of receiving returned merchandise. The customer is responsible for payment of return shipping charges. Returned merchandise must be in new condition so it can be resold. We will not be responsible for any damaged incurred on the return shipment. Refunds will not be issued for items that are returned in poor condition. It is the responsibility of the customer to initiate any claims with the carriers involved as to items damaged in return shipment.
Shipping Damage Policy
All orders have been checked twice for accuracy and products have been inspected at our facility prior to shipment. After the shipment leaves our facility, the freight carrier is accepting responsibility for delivering the order as it was accepted on the bill of lading (complete and in good condition). We need our customers, YOU, to do the same upon delivery. It is the responsibility of the customer to open and inspect all packages upon receipt: checking for damage and comparing contents with the packing slip. The customer is required to note any damage in writing (on the bill of lading) to the delivering carrier at time of delivery to be eligible for reimbursement. All claims for shipping damage or missing product must be reported to us within 5 business days after delivery. This may be done by email to firstname.lastname@example.org or by calling our office at 435-649-2805. We will handle all claims with our freight carrier on the customer’s behalf and ship replacement product ASAP. Digital pictures will be needed to assist us in our claim with the freight company. Email digital pictures to email@example.com. No damage claims will be accepted after 5 days from receipt of delivery. If we receive notice of damage within 5 days of delivery, the customer will not be responsible for any additional charges.
Disclaimer of Warranties
Park City Rain Gutter warranties that the product you receive is what you have ordered. Park City Rain Gutter makes no other warranties, either expressed or implied and specifically disclaims any implied warranties including any implied warranty of merchantability or fitness for a particular purpose. The customer agrees not to hold Park City Rain gutter responsible for any delay caused in whole or in part by circumstances beyond Park City Rain Gutter’s control; including by not limited to delays by carriers, delays in shipment or receipt of materials from suppliers, or force majeure. Park City Rain Gutter will not be liable under any circumstance for consequential or incidental damages arising out of or in connection with your order. Park City Rain Gutter’s liability is limited to repayment of the purchase price of items not conforming to the description on the Park City Rain Gutter invoice after return of said items to Park City Rain Gutter. This remedy is your exclusive remedy. You agree to indemnify and hold Park City Rain Gutter harmless from and against all claims, demands, actions, causes of action, costs, expenses, and attorney’s fees arising out of or in connection with any injury , including death, to any person or persons, and any other damages recognized at law or inequity, caused by or resulting from in whole or in part, any act(s) or omission(s), negligent or otherwise, by you or by any of your agents, servants, employees, subcontractors, or customers. In the event that the applicable law prohibits enforcement of this clause as written, then and only then, this clause shall be modified to provide maximum indemnification allowable under the applicable law.
